Intentionally Shoot the Clerk



So I was just reviewing learning criminal law.  Turns out that in most jurisdictions felony murder is considered Murder in the First Degree.  (Handout page 16).  But felony murder is usually unintended.  Because, after all, "[i]f it was an intentional killing, charge Murder in the Second Degree instead." (Id. page 17).  The lesson is this: if you think you're going to accidentally shoot the clerk, shoot him on purpose instead.
